Hanoi shortens land use fee calculation time for land certificate issuance

From July 1, Hanoi requires tax authorities to have a maximum of 5 working days to determine the land use fee that citizens must pay when applying for red books, instead of 7 days as previously.

This is one of the new points in Decision No. 84 of the Hanoi People’s Committee on the process of transferring files to determine land-related financial obligations. The decision takes effect immediately from its date of issuance – July 1, 2026.

For cases applying the land price frame to calculate land use fees, the city requests the Department of Agriculture and Environment to transfer the cadastral information of the land plot (area) to the Hanoi Tax Department within 7 working days. This timeframe is similar to the previous regulation.

However, Hanoi requires tax authorities to determine land use fees, unit prices, land rent, or other financial obligations (if any) within 5 working days after receiving the information transfer slip from the Department of Agriculture and Environment. Thus, this timeframe is reduced by 2 days compared to the old regulation.

Similarly, in cases where the application lacks sufficient basis to calculate land use fees or land rent, the tax authority has 3 days to issue a notice requesting the parties to provide additional information. This new regulation is also shortened by 2 days compared to before.

Next, after the land user pays the full amount, the budget collection agency must transfer the information to the Hanoi Tax Department to confirm the completion of financial obligations within 2 days. Then, within 3 working days, the tax authority must send a written confirmation to the land user, the Department of Agriculture and Environment, and the Land Registration Office.

The written confirmation of completion of financial obligations is an important basis for handing over land on-site, signing land lease contracts, and issuing land use rights certificates to citizens. In the previous process, Hanoi did not have specific regulations for these two milestones.

Process of transferring files to determine land-related financial obligations in Hanoi

In cases of applying specific land prices, Hanoi’s new process also features major changes in time allocation and implementation steps.

Regarding the timeframe for selecting a land valuation organization, the new regulation clearly divides it into 45 working days for bidding or 15 days for direct appointment. The old regulation only grouped this timeframe into 60 working days.

From July 1, the time for land valuation units to perform the sequence and procedures for determining specific land prices is increased to 45 working days, an increase of 15 days compared to before. This may help valuation consulting units have more time to formulate better quality land price plans.

Conversely, the time for the appraisal council to issue a decision approving specific land prices is reduced from 15 days to 6 working days. The time for the Chairman of the City People’s Committee to decide on specific land prices is also cut in half, to 5 working days.
